childsupport

me and my husband just got divorce after 21 years.he is now disable.dont he have to pay childsupport for are three children ages 9,13,14, they live with me.and if he dont cant i get ssi for the children sence he cant support them.any advice would help.

Every parent has an obligation to provide child support, but it's based on his/her income. If your ex is disabled and thereby unable to provide income, you should be able to get it through his SSI. There are child support guidelines that will tell you how much three children are entitled to. You really should consult a family attorney or go to the child support enforcement office in your county for assistance.

If your ex-husband is receiving Social Security disability insurance benefits, the children in your custody should be receiving dependents' benefits from the Social Security Administration. If he is receiving no income other than SSI (Supplemental Security Income), those payments are not counted as income for calculating child support. If he has ANY income other than SSI, he should be paying child support. You can file for support with your local child support enforcement office.
