The payment of child support or the failure to do so does not determine who has custody. That is based upon what is in the best interests of the child. Courts generally tend to give joint legal custody if both parents seem responsible, meaning each can be involved in decision making. However, usually one parent has sole residential custody and the other has visitation rights.
