Legal Question in Family Law in Maryland
I committed Adultery
I was married young because I was pregnant and I don't love my husband. I haven't been in love with him throughout the entire marriage. I was very depressed and lonely and I cheated on my husband with a man that lives across the street from us. When my husband caught us he beat the man up right in front of me. It was horrible. He is in the military so we have moved around alot, I am here in MD all by myself, I have no family here and all his family lives in MD so it makes it really hard on me. He holds the adultery over my head and makes me feel like I owe it to him to stay with him. I am not a bad person. I just don't love him. Can he take my two kids away from me. Will I have to pay him alimony and child support? Will he get our property. What can I do, if anything? I just want to move on with my life and him to move on with his.
Sincerely,
Broken hearted and lonely with no where to go.

Re: I committed Adultery
Divorce and custody are two separate matters. In fact, in Maryland, child support can be granted without a judical decree of custody, although I strongly suggest that this not be your course of action.
Has the man that he beat up filed a complaint? Irregardless of any adulterous affair, real or perceived, no person has a right to batter another and this is a criminal offense. If your husband has a proclivity for violence, a complaint to the police by someone who was beaten by him may be evidence that could be used in a court contest for custody.
You should consider contacting the Maryland Domestic Violence Center in the county of your residence to inquire as to how they can help you. Please be advised that once a legal service is involved, you may forego the benefits of private counsel.
