Legal Question in Family Law in Maryland
Complaint for Absolute Divorce
If a separation agreement is never signed by my husband what happens to marital assets (specifically stocks and retirement funds) if a complaint for absolute divorce is awarded by the court?
The complaint spoke only of custody of the child, vehicle, and personal property.
He responded to those items and then states: ''For such other and further relief as the nature of this cause will allow.'' What would that mean?
Thanks for your help!! It is greatly appreciated.

Re: Complaint for Absolute Divorce
Your husband is seeking to have the court divide up all of your marital property, and it's important that you make sure your rights are protected. For example, you probably have a right to a portion of his retirement accounts and plan benefits, and he has a right to yours. All non-retirement financial assets are also subject to division in the divorce, regardless of whose name is on the account, unless they were individually owned prior to the marriage or received individually during the marriage by gift or inheritance. I strongly urge you to consult with an experienced family law attorney before proceeding further with the case.
