Constructive desertion happens when one spouse's behavior towards the other is so intolerable that the continuance of the marital relationship is unbearable. Whether or not a spouse's conduct constitutes constructive desertion depends on the facts and circumstances of each case. Constructive desertion is grounds for a divorce in Maryland.
