Legal Question in Family Law in Maryland

Court Order Modification

The Juvenile Court in Prince George, Va. issued a court order providing me with joint custody of my son in 2003. At the time I was a resident in Virginia; my son was living with me because the mother was in Iraq. I am in the military and now stationed in Michigan and have been for over a year. My son's mother was deployed in June 2005 and our son lived with my Mother in Maryland for over 13 months. My son's mother has recently returned and they are now living in Colorado for the past month. I want to go back to court and request a modification to visitation rights; have child support included in the court order and bring up other critical issues regarding her hostility. Where do I file a petition to amend this order - Virginia, Maryland, Michigan or Colorado?

I can't seem to get an answer for this question. Please advise. Thank you.

Well the answers is not absolutely black and white. There is more information that is needed in order to attempt to point you in the correct direction. However, even after meeting with an experienced family law attorney, there might be some variations in the answer and the interpretation by different judges.

Until your son has been a CO resident for 6 months, I think jurisdiction lies with the original court in VA. After his CO residency is established, CO could take jurisdiction under the Uniform Act governing these situations (assuming CO has adopted that law as part of their laws). By the way, did you mean KING George, VA?
