criminal non support filed/adoption

my wife adopted my son in 2004. There was a arrearage order dated for the large amount of arrears owed in the child support case. I was advised that since the ncp hasstill not paid anything towards that amount, that I was entitled to file for criminal non support. I do not want to file incorrectly since there is no continuing order, just the arrearages. would this be the wrong avenue to take? thank you

You can do that by applying to the state's attorney's office in your county. Some counties may require you to go through the Office of Child Support Enforcement, an arm of the court, if they have one. If so, check with them first.

If your ex is gainfully employed, you should be able to get an earnings withholding order and serve it on the employer. They will then be required to deduct a set amount from the paycheck and send it directly to you. That would probably be quicker than using the criminal process.
