Legal Question in Family Law in Maryland

Hi: I"m right now in a custody battle with my soon to be ex husband.

He was married before me with another woman in another country (cuba) and he did not get divorced over there before to married me in my country (in latinomarica also). My question is how this situation can affect him in thecustody trial for visitation andfor him to have more overnights with my 3 years old son.

Also, I have a protective order against him and I just filed criminal acharges because of a violation of the protective order.

Are his parent rights (visitation and overnights) independent of any other issue he may have or the court takes them in account?

The court will consider many factors in the custody and visitation case, including domestic violence protective orders and any past criminal convictions he may have. Ultimately, the court determines these cases on the basis of what is in your son's best interest. Among the factors considered are the character and fitness of the parents, where the child has been residing and how well he is doing in that environment, etc.
