custody case
My brother-in-law's ex-girlfriend has taken his 3 children (one of which is not hers) out of state and has filed an ex parte order of protection and has recieved temporary custody of the children....the father would like to give us custody of the child that is his, how is this possible? They were living in North Carolina, then moved to Maryland with the father, now she has taken them back to NC...we live in Virginia.If we can get him and the biological mother to give us custody can we take the child?

Your brother in law will have to challenge the court order giving the ex temporary custody of the child that is his but not hers. If he is able to regain custody of that child, then you can go to court to get an order of guardianship with his consent.
