When the fathers identity was falsified what is the likely hood that they will get custody?

If there is a question as to who the bio father is, either parent can file a petition to establish paternity in court and request a dna test. If it turns out that he's not the real father, then he loses all parental rights.

That would be one factor, among many, that a court would look at to determine custody. Since each case is different, it is impossible to predict with one fact alone, who would be granted custody.
