Custody Default Hearing

I filed for custody of my grandchildren who have lived with me for the past six months. Neither parent responded to the petition. There is a default schedule hearing, I don't know if they will show up or not. What happens at this hearing? Will I have to present evidence as to why I should have custody. The children were brought to me by CPS due to neglect. CPS told me they cannot give me anything to take to court to present. Neither parent has had a job for the last 2 years. Mother will be going to jail for failure to pay child support and father will be going for violation of probation.

Re: Custody Default Hearing

If you are the only one at the hearing, the judge may ask you some questions about your living accommodations, supervision plan for the children, and so forth, in order to determine whether you are fit to have custody. If they appear to be doing well since coming to live with you, you should have no problem.
