Custody of Someone Elses Child

My girlfriend has moved to Germany and her 13 year old son is not happy and wants to come and live with my husband and myself..What do I need to do to be able to legally register him in school and to have him stay here with us.Considering she is out of the country and i am here..Can we do a private agreement in writing and notorized or does it have to be a court order?

You need to petition the circuit court of the county in which you live to appoint you as the child's guardian. Present signed consents from the parents and you should have to problems. This appointment is necessary for school enrollment and other things, such as medical treatment and participation in other official activities.

Father and mother could transfer custody under oath, with their signatures notarized. In girlfriend's case, signature would be notarized by a Vice-Consul at the US Embassy in Bonn. Agreement should provide authorization to determine schooling and to provide medical care. Finally, it should provide for child support. I do not believe a court order is necessary, but if it were, you could probably get one in MD by presenting the agreement I described.
