Legal Question in Family Law in Maryland

custody

I orginally had custody of my daughter but then her father and I got married. We never changed the custody order and now him and I have seperated. We have only been married for 5 months and I was wondering if the custody order was still valid or if we had to go through all of that again.

Re: custody

I think the Order is still valid as long as there is no language in it specifically addressing such a circumstance (and I doubt there would be). If the father is contesting the Order, he could argue that a material change of circumstance has occurred since the Order was entered (the marriage) and ask the court for a modification.
