Custody Rights

Currently i have joint legal and physical custody.Over a year ago i signed an agreement that our daughter would visit him in VA for 6 months and be with me for 6 months,as of now he has not followed through with the agreement. he is in the navy and when he is not in MD his parents have legal rights in place of her father. he is in town and see's our daughter about 2 times a month. my question is can i go to court and get back my sole physical custody and joint legal? is this something that is possible or is it not?

Yes, it is possible to modify the custody order. You will need to demonstrate to the court that a substantial change in circumstances has occurred since the existing Order was granted and that the modification would be in the child's best interest.

If the agreement was not filed with the Court, you might not have to do anything but follow the original decree giving you full custody. If the agreement was filed, then you can petition the Court for a change since the father has not abidded by the agreement. In either case, you should discuss this with a lawyer, like myself.
