Legal Question in Family Law in Maryland

What custody rights does non-contact father have?

Bioligical father pays court ordered child support for 2 year old child. However,he has no contact with child. In future, if he decides to contact or see child, what custody rights will he have. If he has rights, can I go to court to block them now in order to prevent an argument in the future.

Re: What custody rights does non-contact father have?

First off, a non custodial parent does have rights to visitation. The Court looks very poorly upon parents that do not allow the other parent to have visitation.

Second, if there is not a Court order in effect regarding custody of the child, (only a child support order) then the non custodial parent could legally come to your house and take the child.

I would recommend seeking counsel to either modify a custody or order that may be in effect or to file for an order for custody and visitation to be set by the Court
