Legal Question in Family Law in Maryland

custody

Me and my sons father have temporary joint custody of our 2yr. old his father has temporary residental custody of him. I got myself into a financial situation that left me basically homeless so I moved out to oklahoma from maryland so i could enroll in school and get a part time job. But as soon as I got out here i recieved a letter from the circuit court saying we have to atend a medition on feb.19th and 3 seminars for familys in transition the court date is march 19th. I can no longer enroll in school because ill have to go back there and do all this so soon. I dont think there going to give me custody of my son when im living at my fathers all the way out here, and cant show proof of bettering my life because i now have to go back there. I guess my question is do you think I could move back to maryland and move back in with his father just so we can both be with our son? What exactly do they decide on in court? And if you think us moving bacj in together would basically get the courts to make a final decision of joint residential and legal custody, considering neither of us filed for this my mom tried for emergency custody b/c she didnt want me to take my son to oklahoma with me. Nice mom hu?

Re: custody

The parents usually have priority when it comes to who gets child custody, but the court must look out for the best interests of the child. If you can show some stability in your son's life by living with the father, that would be a step in the right direction.
