Custody/ Visitation

My wife and I have been separated for a year and a half. I live in Maryland and she along with my daughter moved to Pennsylvania. Child support has already been awarded to my wife but she has not let me speak to or see my daughter in 9 months. I can't just take her away or go to the house because she can file for harrassment and that will hurt me in the long run but there is no legal agreement when it comes to custody or visitation. I never agreed for her to take my daughter out of state. What am I going to do about this short of kidnapping? I have no say in anything and my wife and her family won't let her hear my messages or receive the cards that I send her.

If a Maryland Court Ordered Child Support, you can Petition that Court for visitation. Since your child has resided in Penn. for more than 6 months, you could be forced to file your petition in that State. You should talk to a domestic relations lawyer, such as myself, as to your best course of action.

You state that you have been separated for over a year. Have you filed for divorce yet? If not, in your petition for divorce you can ask for visitation rights. If an agreement can be mediated prior to the divorce and made part of the divorce decree, that would be good.
