Legal Question in Family Law in Maryland
Custody
My wife is asking for sole custody of our 10, 9 and 3 year old. She is saying that she should get sole physical and legal custody because she has been a stay at home mom there whole life and she has been the one there for them. Is this usually valid? How can my role of working for a living be used against me? Does the man have any leg to stand on to ask for custody because I provided the finances for everything and now my wife wants 2600 a month to be able to stay home and have the summers off to watch the kids.

Re: Custody
The courts tend to maintain the status quo where children are involved. Ultimately, the standard is what is in the best interests of the children. Unless you can show that granting custody to you will put them in a better situation, the fact that she has been with them so much will weigh heavily in her favor regarding physical custody.
Legal custody is another matter. Joint legal custody is fairly common where the parents can communicate when it comes to making decisions for the children.
Regarding her being able to stay home, she will be required to work, absent some special need of any of the children that requires her to be home. In general, she is expected to support the children financially as well.
