Legal Question in Family Law in Maryland

I Want to know if I am dad!!

I was told by a woamn I was living with I was the faher of her newborn child. We also share two previous children. The woman is married and placed her husbands name on the certificate. She is denying me access. She was living with me at the time of conception, and the initial 2 months of the pregnancy. What can I do legally since MD has a law stating a child born within wedlock is the husbands?

Re: I Want to know if I am dad!!

There is a presumption that a child is the child of the mother's husband, but the presumption can be rebutted. Evidence that you and the mother were living together at the time of conception would help rebut the presumption, and DNA testing would provide even better evidence. You can file an action in the Circuit Court to establish paternity and gain visitation rights and the obligation to pay child support, or possibly (but less likely) the right to custody.
