Legal Question in Family Law in Maryland

dating during limited divorce

I have a limited divorce. Custody has been established jointly. I also am getting temporary alimony and child support. Since custody has been establised, can I start dating? He started dating 3 weeks after I filed for limited divorce and is still seeing her. I was seeing someone also 3 months after I filed for divorce, but my attorney insisted I had to remain single. Since we both committed adultery (he did first) doesn't this cancel out in court with each other? We separated in Nov. 2006 and our final divorce is in Jan. 2008.

Re: dating during limited divorce

If neither party has made an adultery claim so far, I don't think it's a real problem if the relationship began after the separation. But remember that custody is never set in stone. Changing conditions could cause him to petition for a change in custody, and if the court is convinced that it would be in your child's best interest to do that, it could happen. I trust you are acting discreetly with your boyfriend when in the presence of your child.
