Legal Question in Family Law in Maryland

Getting my daughter back

I currently have custody of my daughter but i have to sign away temporary custody to her dad because i am joining the military. How can I garauntee that I will get my child back? We have already gone to court and the court order says that the child is to remain in my custody and he can enjoy visitation. he currently pays me child support. I just want to make sure that i can and will get my child back when i return from basic training in about 4months.

Re: Getting my daughter back

You should not need to "sign away" custody temporarily unless your child's school requires a signed statement indicating that in your absence the father is responsible for the child's care. There should be no need for any intervention by the court to change custody for the four month basic training period. But while you are away you should maintain as much regular contact as you can with your child, by mail, telephone, or whatever, and or course temporarily cancel the child support. For that you will need to contact the Child Support office of the Department of Social Services. If you have family living nearby, I would suggest that you make arrangements with your family to maintain regular contact with your child and that you make it clear to the father that you still have custody and the right to make decisions about your child's care. And try to maintain a civil and cooperative relationship with the father.
