Really need help
My daughter and her husband are fighting over custody over their daughter but his mother has made it her problem and is using the law to help her. She is haressing my daughter. She has gotten an expartee against my daughter saying she threatened her,tonight the police picked my daughter tonight with a court order to go get evaluated at the hospital because this woman has said my daughter has threatened to kill herself and has stopped taking her medication. These are all lies.This women has called my exhusband and told him she will use any means she can to take my daughter's child,also she has called protective services.Isn't there something my daughter can do to protect herself?

Your daughter should retain a lawyer immediately to protect her interests. She cannot be involuntarily hospitalized unless a court determines that she is a danger to herself or others. Obviously a suicide threat would qualify as such under the law, but if her mother-in-law fabricated that, that should be brought out in court. She can have a psychiatric evaluation to determine her mental status.
As far as the custody issue is concerned, she needs to put herself in a posture to demonstrate that her daughter is better off with her than with the father. An experienced family law attorney will know how to obtain and present the evidence to best serve your daughter on this issue.
