Legal Question in Family Law in Maryland

I have two daughters that have for most of their lives lived with their mother, who now resides in FL. My youngest daughter who is almost 12 now wants to live with me and her stepmom in MD. My question is about child support. My older daughter will continue to live with her mother, but with me having the younger, do I still pay support? Does the mother pay me half and I still pay her the other half? Do they cancel each other out? Thanks for any info.

If primary custody of the younger daughter were to change from with the mother to with you, the child support order/agreement would have to be modified accordingly to account for the fact that each of you are caring for one of the children. The support for each child would not necessarily cancel each other out, however, as factors such as how much each parent earns and the support guidelines in the two respective states would come into play. You may be able to amicably work out an agreement with the mother on support, but if you cannot, or if you are at all uncertain about any aspect of this new arrangement, you should consult with an experienced family law attorney. Your need for an attorney will follow the state where the support order is entered (i.e., Florida or Maryland.)

An adjustment of the support is based on days of physical custody where there is split physical custody in the order. Modification should be sought given the facts you describe.
