family home for 40 years recently had my name added to deed then did refinance and added husband of 3 years who is entitled to property

The law regarding marital property is complex, especially when situations such as this arise. If the husband is a party to the debt on the home and is a named owner on the deed, then the property is most likely at least partially marital. As such, he would be entitled to a portion of the equity, depending on how much of the equity was acquired during the marriage via appreciation and paying down of the principal of the mortgage.

If the house was gifted to you or you acquired it via inheritance, that portion of the existing value would be considered non-marital.

I would suggest that you consult with an attorney as the applicable law is complex.
