My husband trying to divorce quickly on the grounds of adultry. If he deserted me and move to a different state proir to the alleged adultry is it still considered adultry?

I agree with the previous answer. However, for strategic purposes, you may want to file a counterclaim for desertation. This counterclaim may be important for division of assets. (More information is needed to determine if all the elements of desertation are present).

Divorce

Adultery is a married person having sexual relations with someone other than the spouse. It does not matter what State they are in, or whether the parties have previously separated. As long as they are not divorced.
