Legal Question in Family Law in Maryland

Looking for a divorce lawyer

I'm looking for a lawyer with experience representing a non-military spouse of a retired (20 years) service member. We were married in 1979 in MD, and have been separated since '93 (not legally). I'm ready for a divorce and am looking for someone who has experience representing the spouse of retired military members. We have two children, 21 and 17, and they've always lived with me. I do not have $5000 for a retainer (as I was asked by one lawyer). My husband currently resides in Georgia. Thank you.

Re: Looking for a divorce lawyer

There are not a lot of differences in the issues in a divorce case because of the husband's history as a retired member of the military services. You can file for divorce on a no fault ground of two or more years separation, and since you have always had custody of the children, there should be no issue there. The only issues in Maryland law would be related to property, including a military pension and any other property which was acquired during the marriage, and support for the younger child for a short time. I have represented retired career military people, spouses of people retired from military service, active duty members of the military, and spouses of people on active duty, and I was employed for ten years by an attorney who was a retired army officer. My office is located in Western Maryland, but I have represented family law clients in central and eastern Maryland. I would be happy to talk to you.

Re: Looking for a divorce lawyer

I have handled these kinds of cases and would be happy to assist you. My office is located in Chevy Chase. You can contact me for further information at 301 986-4555.

My primary objective would initially be to negotiate a separation agreement which includes provisions for your portion of your husband's retirement benefits if you are not already receiving them. This can be done by court order if your husband refuses to cooperate. The agreement would also divide up any other marital property that you may still have in joint names. You will want to provide for your younger child's college expenses; I assume he's been providing support up until now.

I look forward to hearing from you.
