How long does a couple have to be seperated before they can file for a divorce.

If the divorce was by agreement of the parties, one year. If it wasn't, 2 years.

One year for absolute divorce.

In Maryland, the parties must live separately and refrain from sex for at least one year (for voluntary separation) or two years (involuntary separation). There are other grounds for divorce that do not require separation (e.g., adultery, constructive desertion). Moreover, if one party has moved to DC, it is only a six-month separation period there for a no-fault voluntary divorce (and one year for involuntary). We handle divorce cases in both DC and MD.
