Legal Question in Family Law in Maryland
Divorce
I wish to divorce my wife, we have been separated for 11 months. I currently live in Ohio, she resides in Maryland. We were married in Virginia. How and where do I have to file? I want this to be over as soon as possible!

Re: Divorce
In Maryland you must have 12 months of separation to file for divorce on the grounds
of voluntary separation. If either party contests the grounds then 24 months is required to file
for involuntary separation.
Based on the facts stated, you appear to have jurisdiction in Maryland, that is that you could file in Maryland
after having a 12 month separation.
It is advisable to speak with an attorney to pursue a separation agreement and this you can do now.

Re: Divorce
You should begin to prepare now, so that as soon as you meet the 1 year voluntary separation requirement of Maryland law you can file. Since your wife lives in Maryland, Maryland does have jurisdiction. If the matter can be resolved, so that it is uncontested, you could be in Court and divorced within 90 days of filing. You begin by filing a Complaint for Divorce. Consult a Maryland Lawyer, like myself, to discuss all your rights under Maryland Law.
