Divorce Woes
I am seeking a divorce from husband. We have no children or leagally binding accounts together except for our home. It was purchased my him and we refinanced it in August 2004. I'm solely on the home loan, we both are on the deed. He was in foreclosure when we refinanced in my name. He has 1 child out of his 5, and i have 1 child only living in the home with us. 1st marriage for us both. Problem is hubby won't agree to sell home, we tried to refi in his name only, but he could only get approved for 75% of loan amount (loan amt 104,000). He is self-employed and has been for almost 2yrs - Towing co. He won't leave, I have nowhere to go. Can i file for absolute divorce while we are both still in the home or force him to sell? Please tell me what my options are.

The real property will be divided between the parties upon the granting of divorce. But, other options exist such as family home.
You cannot file until the grounds sought are satisfied. Thus a one-year voluntary basis cannot be filed until there is one complete year of voluntary separation without cohabitation (i.e., sexual relations.) Other grounds may apply.
