Re: divorce after 39 years

First, your mother needs to get out of the home.

She needs to then contact an attorney.

As for what she is entitled to:

Maryland law allows for alimony, especially when the marriage is so long and there is a disparate income between the parties.

Furthermore, the court will inform the parties that all assetts acquired during the marriage are marital property and that they must be divided equally among the parties. (unless there are extenuating circumstances)

I would strongly encourage your mother seeking advice on this matter.

Re: divorce after 39 years

Under Maryland law all property acquired during the marriage will be divided between your parents (as well as all marital debts). If your mother is unable to earn income, the Court would consider alimony to be paid by your father. She should immediately seek the assistance of an attorney. The attorney can ask the Court to order you father to contribute to his fee for representation of your mother.
