Legal Question in Family Law in Maryland

I'm trying to get divorced in Maryland. The judge dismissed the case because I can"t find my soon to be ex to serve him the summons, as he's hiding from the law (I think in PA). Is there a time when I can just file and be granted a divorce? Someone told me after two years I can. (I have tried to send certified mail-returned, call his family-no one knows, wasted money on Intellius-5year old address)

Service is still required even if the grounds are separation for two years. There is a way to potentially move the case forward in spite of a lack of service. You can file a Motion for Alternate Service. This requires that you detail the efforts you have made to serve him. If granted, service would be accomplished by posting or publication and the case could move forward. Forms are available on the Maryland Judiciary website or at the Circuit Court clerk's office.
