Legal Question in Family Law in Maryland

Earnings (Pt 2)

Desperate please advice!! (Atty Robert Sher) I proceeded not to have my attorney seek my now ex-husbands income. I let my ex talk me out of going after him for money. I should have known he was lying when he cried broke. Since the divorce in Nov 2007; I know he made a killing back when the real estate market was hot. I have discovered so many things about him; he allowed some woman to use our last name while we were still married from 2004 to present; he fathered with this woman triplet boys; he took money from the house for other things outside the home; he moved out and bought a home and a car with her in 2005 while we were still married. My ex and I started a business in 2002 that he claims no longer exists; I found out that it's thriving and he also claims that he no longer owns the business;well I found out otherwise; he pursuaded me to keep him on my health insurance and he promised to pay the deductions taken from pay check for his doctor visits and medicine which has not happened.

On top of all this he is mad at me - go figure!! My question is can I still go after him for part of this business which I very well helped start. I am also thinking about going after his property.

Please advise!

Re: Earnings (Pt 2)

Under MD law, a court hearing a divorce has the jurisdiction to determine which property is marital, its value, and how to divide it either at the time of the divorce or thereafter within 90 days if the court has expressly reserved the right to do so at the time of the divorce. If that didn't happen in your case, you've lost that opportunity. You could still sue him for an interest in the property in a separate legal action, including the value of the business.
