Legal Question in Family Law in Maryland

Emancipation of Minor

I have a 16 yr old daughter. She refuses to adhere to any of the household rules and just does what she wishes. However she know that I can't legally kick her out of the house. Can I have her emancipated so that she will at least have some consequences to her actions?

Re: Emancipation of Minor

It's extremely unlikely that a court would allow you to "involuntarily" emancipate your 16 year old child, unless she somehow were fully self-supporting or married. Despite her bad behavior, you still have a duty to support her until she's 18 or out of high school, along with her other parent if he/she's around. One course of action you might consider is asking the local state's attorney in your county whether they would file a "child in need of supervision" (CINS) petition. This would bring your daughter into the jurisdiction of the juvenile court system, where there might be programs that would improve her behavior and make her less likely to get into trouble.
