Am I entitled to half his pension?

My stbx was injured on the job during our marriage and is now receiving state disability/retirement payments for the rest of his life.

He is only 40% disabled and was put out on early retirement.

We were married for almost 8 yrs. Am I entitled to any of that income?

You could have made a claim for the benefits he received while you were married as part of the divorce. However, the courts have held that the benefits received after divorce are not marital property.
