can you put an expartee out against a stepmother not seeing my daughter because she is petrified of her .

Only if you have a factual basis for doing so. In other words, if the stepmother has harmed your daughter or threatened her with physical harm, you could seek an ex parte. If issued, that would be followed up by a court hearing a week later, and you would have to be prepared to back up your accusations. Since the stepmother is inevitably going to be present when your daughter has visitation with her father, it is going to be difficult to convince a judge that the stepmother can't be around during these visits.
