Legal Question in Family Law in Maryland

My mother has been babysitting for a month while I was out of town getting treatment for addiction problems. I cam home today and she has filed for sole custody of the children. My husband has been there on the weekends and has paid her 100.00 per week for support. If I give my husband sole custody ,his named on both birth certificates can he take the children from her. He has no criminal background and has been there.

Your husband can take custody and has a superior claim to your mother. I assume there's no court ordered custody right now. If there is, you need to get the order modified to bestow custody on the father.
