Legal Question in Family Law in Maryland
Father doesn't know what to do
I have two boys 10 & 13. The 13 yr old lives with me and the 10 yr old lives with his mother in Maryland. The 10 yr old would like to be here also. Mother will trade one for the other, but not let both live here. He is left alone quite often to care for a 1 yr & 3yr old, cook thier meals, and keep up the house work. Also she moved to MD March 1st and is still collecting support from Buffalo,NY. The only time we have been in court is too settle paternity and support. He is made to feel guilty about loving and wanting to be with his dad. What can I do?

Re: Father doesn't know what to do
Your question didn't make it clear if the current custody arrangement is by court order, written agreement, or informal agreement between the two of you. If the latter, you can file a petition in either MD or NY seeking custody of the 10 year old. If you decide to do this, the first thing you should do is hire an experienced family law attorney who knows how to put together a custody case. You will probably need an expert, such as a child psychologist or social worker who can interview the boys and is prepared to testify that it would be in their mutual best interest to be together, especially in view of the apparent acrimony between the parents. This will be an expensive process, to be sure, and you just have to decide whether reuniting your boys is worth it.
