Father's Rights

The Ex Parte Order was filed 9/6/00, one day after I visited with my child, 9/5/00, whom I had not seen since 12/31/99.

I retained a Lawyer. A hearing was scheduled 9/13/00. The Judge had just received a report from a social service agency.

My lawyer advised me that the standards for abuse for children are very different; that if the child takes the stand and lies in favor of the custodial parent, coupled with the social services report, that this would not be a favorable situation for me.

Furhter, my lawyer advised me based on his experience that we proceeded to negotiate a Consent Protective Order. Despite my feelings to the contrary. I valued the advice of my lawyer.

Given the complexity of preparing a CPO, the Judge asked sent both lwayers to construct it off-line, which neither side could agree. We asked for an evidentiary hearing in the alternative.

The Judge reviewed the transcripts from the hearing to understand and clarified the issues, and requested an Order.

A Consent Order has not been entered by the Court yet. I did not abuse my child!! I want an evidentiary hearing. What can I do?

You can refuse to sign a consent agreement. If you want a hearing, inform your lawyer of that fact and, if the lawyer doesnn't want to represent you in a hearing, find another lawyer.
