Legal Question in Family Law in Maryland

file for modificaiton of visiation?

The proposed order states that in the summer, he gets a period of four weeks, no more than two weeks to be consecutive. He is beginning the vacation on a sunday at the end of his standard friday-sunday (eow) visitation, and ending it at the end of his standard weekend visitation. That is for a period of more than two weeks and give him 3 weekends in a row. Can he do this. I would think he would have to return my son at the end of the two weeks starting from friday to the following second friday. Please help.

Re: file for modificaiton of visiation?

If the visitation schedule calls for every other weekend during the year, then the first weekend is part of that, as you stated. The summer visitation is a separate component. He is entitled to 2 full consecutive weeks, so from Sunday to Sunday. Theoretically, if you agreed to it, or if he is allowed under the terms of the schedule to pick his 4 weeks, he could start his second 2 week period the next Friday and go through 2 Fridays later, in which case he would end up with 4 consecutive weekends--unless there is another provision in your agreement that prohibits this.
