Financial Responsabilities of a deserting, adultrus spouce.
Husband of two years makes approxamently $45,000.00 per year left wife, biological child, and step child. Mother unemployeed and turned down by SSI due to husbands income is left with no vehicle, no money and no support. Husband moved in with Girl-Friend, driving new car,etc. He did get his daughter after 2and1/2 months. What rights and financial support is due the legal wife and step child? No Legal papers of Seperation have been filed.

You may be entitled to alimony if you can establish that you are unable to support yourself. You would have to file a court action seeking a divorce or legal separation based on his desertion or adultery. You aren't entitled to support for the child that isn't his unless he adopted him or her, which I assume didn't happen. The natural father is responsible for this child's support if he's available. If you seek to regain custody of the child you have with your husband, you can ask for child support for that child and he would have to pay it. On the other hand, if he gets custody, he could theoretically seek child support from you, which might offset the alimony. I suggest you try to get a lawyer who will represent you without fee through the local legal aid or neighborhood legal services office where you live. You should be able to find the nearest office in the yellow pages.
