trying to find out if i should appeal

my ex has reopened an old case pertaining to our divorce to get my a portion of my retierment, who then becomes the petitioner?

She would be. However, if the court, at the time of divorce or within 90 days thereafter, didn't make a ruling on the retirement benefits, and didn't expressly reserve the authority to rule later on this issue, the court is now without jurisdiction to do so. This also,assumes you didn't agree to waive this deadline for determining how much of your retirement benefits your ex would receive.
