Legal Question in Family Law in Maryland

forclosure/divorce

I was in a marriage and divoreced this past June. My husband got the house and had to get my name off in 60 days, he never did. Also he never paid a single payment since then. Is there anything that I can do to save my credit?

Re: forclosure/divorce

Unfortunately, the only way your ex would have been able to get your name off the mortgage was to refinance, which apparently he had no ability or no inclination to do. You need to get his cooperation in exploring a short sale or deeding the property back to the lender--otherwise it will only be a matter of time before a foreclosure takes place and he loses the house anyway. If he refuses and you have a written agreement about this which was incorporated into the divorce, you can ask the court to hold him in contempt and also to appoint a trustee to act in his stead.
