Fraud on Marital rights?
My stbx refied our home and then purchased another one in WV titleing it in his g/f's name. He then let our hse go to foreclosure.
He also stated on his loan app for the refi that his income is over $5K a mo. and $1600 is Soc. Sec. disability. I called Soc.Sec and they stated he is NOT receiving any kind of benefits!
For our child support order, he's stated his income is only $2K mo.
Do I have the right to subpoena his tax returns? And what else can I do to verify his income?

You can subpoena his income tax returns and payroll information in a divorce action. You can also enter evidence in court the documents that show he has not told the truth in other situations. I am surprised that Social Security gave you any information about his claimed disability, but if he were receiving disability benefits from Social Security your minor child would also be receiving benefits (which shows that he is again a liar). As for the house in the girlfriend's name, a good argument can be made in court that he has committed "waste of marital assets" by doing that deal. You should get documentation that that is what he did. I hope you are not doing all this on your own, without a lawyer. These situations are difficult enough even with a lawyer, and to do it alone is a good way to lose.
