Hi my friend is an unwed mother, the father of her baby signed the birth certificate but their relationship hasnot been good. She doesn't want anything to do with him and wants to limit his relationship with his son. She resides in Maryland. Does she have sole custody?does she have to file for it? What can she do?

She has custody in fact but not at law. In order to obtain custody, which is comprised of physical and legal custody, she will need to file in Court. Limitations could be applicable depending on the circumstances, however, he could contest any limits that are sought. She should speak with an attorney to ensure that her case is properly presented and thereby enhancing the probability that she will obtain full custody or primary custody. She can also pursue child support.
