Guardianship of biological child who is and has resided with parent since birth

My son received money from life insurance policy when my wife(his mother)died. Why do I have to petition the the courts for guardianship in order to have access to his money?

Re: Guardianship of biological child who is and has resided with parent since birth

Your petition is not for guardianship of him, but of his property (i.e., the life insurance benefits.) The statute is there to make sure someone in your position is using the funds for the benefit of the intended beneficiary and not otherwise.
