What it may happen?

My husband moved out two years ago. If he file a divorce, how our assets would be divided? Do we still need to reach an agreement to get divorce or court makes decision?

Your marital assets would be divided based on a number of factors, including when they were acquired and the circumstances leading to the breakup of the marriage. The principle of equitable distribution applies. If the assets are at all significant, you will be making a serious and costly mistake if you don't retain an experienced family law attorney to represent and protect your interests. If the two of you can reach an agreement on this issue, and on other issues that pertain to a divorce, it's much better than leaving it up to the court.
