Legal Question in Family Law in Maryland

Health and Privacy Issues

Hi. My husband and I share legal custody. He is one week with me, then one week with my husband. Unbeknownest to me, my mother in law took my son to the dr's and I was not notified, nor my husband. I contatced the dr's b/c she gave incorrect info about his condition and I did not feel she should be taking my son in for non-Emergency medical care w/out notifying or getting authorization from myself or my husband. The dr's office said they do not get involved unless only ONE person has legal custody. Is there anything I can do from having the grandmother NOT permitted to make medical decisions for my son w/out parent approval. My husband feels nothing is wrong with her not telling us he was evn sick! Please help. Thank you so much!

Re: Health and Privacy Issues

If your custody agreement has been ratified by a court in the form of some order, then you(or your attorney) could petition the court to have the order modified so that your son's paternal grandmother is barred from taking the boy on such unilateral visits to the doctor.

Ideally, parents who share legal custody of the child should be able to work out this kind of issue between them without resorting to the courts.
