Hidden Assets

Divorced 5 yrs. now I have discovered my ex failed to claim a property she purchased while we were married. I was working full-time, she...part-time. She purchased it without my knowledge and bought it with money she had taken from our account over a period of years(also without my knowledge). Am I able to "reclaim" a share of this property under marital assets? Am I entitled to half the value of this property after these many years? We were married and still living together as husband and wife with no "apparent" problems at that time. Thank you.

You should be able to recover a part of the value of the property if you can show that she concealed information about it during your divorce proceedings. If your divorce involved a separation and property settlement agreement, you will need to demonstrate that you signed the agreement without knowledge of that property. If the divorce was litigated and each of you had to provide lists of assets, and she signed answers to interrogatories under penalty of perjury and omitted mention of that property, you should be able to re-open the case. You might also persuade a state's attorney to pursue a perjury charge, although usually the state's attorney isn't interested in prosecuting perjury in a divorce action. You will need to get all of the evidence together which shows that the property was concealed from you, and then find a good lawyer to represent you.
