husband adopting another womans child

my husband is planning on adopting one of his girlfriends kids. can he legally do it since we are still married, have separation papers, which have been violated. he has come back to the home several times. is there a statue of limitation for me filing to get the money he signed and agreed on the separation papers?

Based on the limited information you have provided, I see no reason why your husband could not adopt his girlfriend's child. As for the money he hasn's paid to you, if your separation agreement is properly done it is a legal contract, and you could go to court to enforce it.It is unclear from your information whether the agreement applies to money to be paid after a divorce or money to be paid prior to a divorce, and the specific language in the agreement could make a big difference.

Your husband may be able to adopt his girlfriends child. There are many factors involved in an adoption, such as the father would have to consent. A separation agreement, if documented and executed properly, is unenforceable contract that you can bring to court in a lawsuit. If your husband violated the terms of the separation agreement, you would be able to enforce the provisions. Unfortunately, with this limited information, I can only give you generalities, as far as whether your husband could adopt or your possible success with a separation agreement.
