Legal Question in Family Law in Maryland

My husband has a daughter with another women and she said that she spoke to a lawyer and the lawyer told her that she could get my wages garnished to pay his child support since she cant get his because he is on disabilty

She received incorrect information. Your wages cannot be garnished for an obligation that is not yours.

I agree with both lawyers. Moreover, believe legal advice your husband's ex gives. You did the right thing by obtaining independent legal information. However, your husband should think about retaining a lawyer to handle this matters when child support issues come up. If your husband cannot afford a lawyer, he should think about contacting the Maryland Volunteer Lawyers Service.

All prior answers are correct, but be very careful about putting any of your income or assets into an account on which your name appears on title. While the mother of his child cannot garnish your wages, if she obtains a judgment for accrued support, she may be able to attach his assets under certain circumstances, even if your name is on title. You and your husband should both speak to competent counsel.
